Collection, use and disclosure of Personal Information

As a financial services company, TOWER collects personal information about you to provide you with the products and services you request. In most instances, we collect your personal information from you when you fill out an application form or personal statement, but we may also collect information from you which you provide to us over the telephone or internet. In some situations, we may also collect your personal information from a third party, such as your financial planner or adviser, for corporate members your employer or employer's adviser, your health professional or accountant or any other party with which we have an arrangement for the promotion and sale of products offered or distributed by us.

When we have collected your personal information, we use it to provide you with a product appropriate to your needs. For example, your health information is used to assess the risk in providing you with a product, and the pricing of that product. Your financial information is used to determine the insurance cover appropriate to you and your circumstances and the extent to which TOWER can assist.

TOWER discloses your personal information to a number of its related bodies corporate which assist us in providing you with products or services.

TOWER may disclose some of your personal information to external organisations who assist us in administering the provision of the products or services to you. For example, mailing houses, who send you your annual statement or other organisations with which we have an arrangement for the promotion and sale of products or services offered by us 'service providers'. TOWER may also disclose some of your personal information to other parties such as your financial planner or adviser, for corporate members your employer or employer's adviser, your health professional or accountant.

Like other financial service companies, there are situations where TOWER may also disclose your personal information in circumstances where it is:

• Required by law (such as to the Australian Taxation Office);
and
• Authorised by law (such as where we are obliged to disclose information in the public interest or to protect our interests).

We may also use personal information held about you to keep you informed of new products or special arrangements offered or distributed by us, or to conduct marketing activities, and may disclose information about you to our service providers for this purpose.

Security

In designing this website, TOWER has incorporated security procedures and practices that it considered to be consistent with national industry practice. TOWER reviews its security procedures from time to time and updates them when relevant.

Email policy

By communicating with TOWER via email you require TOWER to act without confirming your identity. If your instructions are unclear TOWER is under no obligation to act on such instructions. We need you to ensure that the information you supply TOWER is accurate.

When you email TOWER and TOWER responds, neither your email nor our response is encrypted. It may be accessed by unauthorised persons or organisations.

TOWER will not be liable for any cost, expenses, loss or damage which you may suffer or incur in connection with any action taken or omitted by TOWER in following any email instructions from you.

Accuracy

TOWER relies on the accuracy of the information you provide. If you think that TOWER holds information about you that is incorrect please contact us as set out above and, at your request, we will take reasonable steps to correct it (or suggest alternative arrangements for updating our records). If we decline to correct our records, for any reason, we will provide you with details of those reasons.

Access

Under the National Privacy Principles, you are generally entitled to access the personal information we hold about you. If you wish to access your personal information, then for security reasons, we will require you to complete our Request for Access to Information Form. This will assist us in identifying you to our satisfaction and will also assist us by identifying your policy number/s and the type of information to which you are requesting access.

A Request for Access to Information Form is available from our Customer Service Centre or from the TOWER Australia website. Once a signed form is received at one of TOWER's offices, and you are entitled to access the information, we will locate the information and make arrangements to give you access. TOWER reserves the right to charge you our reasonable costs incurred in providing you access to information held about you. However, we do not impose a charge for lodging a request for access.

When making a request to access your personal information please be aware that TOWER has other related companies in Australia. To access personal information held by our related companies, you should approach those companies directly in the first instance and advise us that you have done so. Similarly, in the event that you wish to access personal information held by your adviser, you should approach your adviser directly or advise us of their name so that we can approach them on your behalf.

We will try to provide you with access to the information you have requested as soon as possible. The time we require to provide you access will depend upon the type of information you have requested.

In certain circumstances, you may not be entitled to access the personal information we hold about you. For example, you may not be able to access the personal information held about you if providing you with access would unreasonably interfere with the privacy of others. If this happens, we will give you reasons as to why we are unable to provide you access.

Requests for access, or further information about how we manage the personal information we hold, should be directed in the first instance to the TOWER Privacy Officer at the above address.

Cookies

A cookie is a short piece of data which is sent from a web server to a web browser on the user's machine when the browser visits the server's site. The cookie is stored on the user's machine, but it is not an executable program and cannot do anything to your machine.

Whenever a web browser requests a file from the same web server that sent the cookie, the browser sends a copy of that cookie back to the server along with the request. In this way, the server knows you have visited before and can co-ordinate your access to different pages on its web site. A server cannot find out a name or e-mail address, or anything about a user's computer, by using cookies.

We may at times use cookies to obtain session details for access to parts of our sites. Cookies are essential in providing a seamless access to some on-line databases. Cookie information is not stored or collected by TOWER.
